1.  General provisions

a) This Privacy Policy of the Online Shop is of informative character only, which means that it does not constitute a source of duties for Service Users or Customers of the Online Shop.

b) The Administrator of personal data collected through the Online Shop is Agnieszka Spytkowska operating under the business name of Infinity Agnieszka Spytkowska, registered in the Business Activity Central Register and Information Record of the Republic of Poland kept by the minister responsible for economic affairs, having its correspondence address and registered office at ul. Walecznych 3/1 57-300 Kłodzko, NIP no. 8831717360, REGON no. 020136600, email address: sklep@infinityfashion.pl, phone no. +48 735 290 299 - hereinafter referred to as "the Administrator", and being also the Service Provider and Reseller at the Online Shop.

 c) The personal data the Service User and the Customer are processed in accordance with the Personal Data Protection Act of 29 August 1997 (Dz. U. of 1997, no. 133, item 883, with amendments). (hereinafter referred to as the Personal Data Protection Act), and the Act on Rendering Electronic Services of 18 July 2002 (Dz. U. of 2002 no. 144, item 1204, with amendments).

 d) The Administrator undertakes to use best efforts to protect the interests of persons being subject of the data, and in particular, ensures that collected data are processed in accordance with the law; that the data are collected for specific and legitimate purposes, and are not subjected to further processing incompatible with those purposes; that the data are relevant and adequate in relation to purposes for which they are processed and stored in a form allowing identification of data subjects for no longer than it is necessary to achieve the purpose of processing.

 2.  Purpose and scope of data collection, and information about data recipients

a) The purpose, scope and recipient of data processed by the Administrator results from actions undertaken by the Service User or Customer at the Online Shop. For example, if the Customer chooses personal pick-up instead of courier delivery while placing the order, Customer's personal data will be processed in order to conclude and execute the Sale Agreement, but will not be made available to the carrier executing delivery activities on behalf of the Administrator.

b) The Administrator collects personal data of Service Users as well as Individual Customers in order to conclude and execute the Sale Agreement or the Agreement for provision of Electronic Services (e.g. account), and also for the purposes of direct marketing concerning Administrator's own products or services provided thereby.

c) Possible recipients of personal data of Customers of the Online Shop:

a) in case of a Customer who chooses the courier delivery service at the Online Shop, the Administrator makes collected personal data of the Customer available to a selected courier company or an intermediary carrying out shipment activities on behalf of the Administrator.

b) in case of a Customer who chooses electronic payment or card payment at the Online Shop, the Administrator makes collected personal data of the Customer available to a selected entity providing such payment services at the Online Shop.

c) The Administrator may process the following personal data of Service Users or Customers using the Online Shop: name and surname, email address, phone number, delivery address (street, house number, flat number, postal code, city, country), address of residence / business activity / registered office (if different from delivery address). In case of Service Users or Customers who are not consumers, the Administrator may also process the company name and tax identification number (NIP) of the Service User or the Customer.

d) Provision of personal data, referred to in the point above, may be necessary for conclusion and execution of the Sale Agreement or the Agreement for provision of Electronic Services at the Online Shop. The scope of data required to conclude the Agreement is indicated on the website of the Online Shop and in the Rules and Regulations of the Online Shop.

 3.  Cookies and operational data

a) Cookies are small text files sent by a server and stored on the Online Shop visitor's end (e.g. on the hard drive of a PC or laptop, or on the memory card of a smartphone - depending on the device used by a person visiting our Online Shop).

b) While the Online Shop's website is visited by a visitor, the Administrator may process data stored in cookies for the following purposes:

a.     identification of Service Users registered in the Online Shop and viewing logged users;

b. remembering products added to the cart in order to place an order;

c.     storage of data from completed Order Forms, surveys or Online Shop login data;

d.    adjusting content of the Online Shop to individual preferences of the Service User (e.g. colour, font size, and page layout), and improving user experience on the Online Shop's website;

e.     recording anonymous statistical data showing the usage of the Online Shop.

c) Most web browsers available on the market accept saving cookies by default. Everyone may determine the conditions for using cookies by adjusting settings of their own web browser. This means that you can, for example, partially disable (e.g. for some time) or completely disable saving cookies - in the latter case, however, it may affect some functionalities of the Online Shop (e.g., it might be impossible to place an order via the Order form due to the fact that products will not be stored in the shopping cart during subsequent steps of placing the order).

d) Web browser settings regarding cookies are relevant from the perspective of consent for the use of cookies by our Online Shop - in accordance with legal provisions, such a consent may also be expressed through the web browser settings. In the absence of such express consent it is necessary to adjust web browser settings regarding cookies.

f) The Administrator also processes anonymous operational data related to the use of the Online Shop (IP address, domain) to generate statistics used in the process of administration of the Online Shop. These data are anonymous and of collective character, i.e. do not contain elements identifying visitors of our Online Shop. These data are not disclosed to third parties.

 4.  Data processing

a) Provision of personal data by the Service User or the Customer is voluntary, but failure to provide personal data - on the website of the Online Shop and in Regulations of the Online Shop - necessary for conclusion and execution of the Sale Agreement or Agreement for provision of Electronic Services renders conclusion of the Agreement impossible.

b) The basis for processing personal data of the Service User or Customer, being party to the Agreement, is the necessity to execute the Agreement or to take actions on request of the Service User or Customer before conclusion thereof. In case of data processing for the purpose of direct marketing of products or services offered by the Administrator, the basis for such processing is the consent of the Service User or Customer, or fulfilment of legitimate objectives pursued by the Administrator (in accordance with Article 23 (4) of the Act on Protection of Personal Data, a legitimate objective is, in particular, direct marketing of products or services offered by the Administrator).

5.  Data content control data correction

a) The Service User or Customer has the right to access their personal data and to correct them.

b) Every person has the right to control processing of data - concerning this person -contained in data set of the Administrator; in particular, it refers to the right to request completion, update, or correction of personal data, temporary or permanent suspension of data processing, or removal thereof if they are incomplete, wrong, or collected in illegal way, or if they are no longer needed for the purpose for which they were collected.

c) In case of giving consent by the Service User or Customer to the processing of data for direct marketing of products or services offered by the Administrator, such a consent may be revoked at any time.

d) In order to exercise the rights referred to above, it is necessary to contact the Administrator in writing, by mail or by e-mail sent to Administrator's address indicated at the beginning of this privacy policy.

6.  Final provisions

a) The Online Shop may contain links to other websites. The Administrator suggests that privacy policy of such websites should be checked when visiting such websites. This privacy policy applies only to this Online Shop.

b) The Administrator applies technical and organizational measures to ensure protection of personal data processing adequate to the risks and category of data being protected, and in particular to protect data against their unauthorized disclosure, collection by an unauthorized person, processing with violation of current laws, and any change, loss, damage or destruction.

c) The Administrator shall use suitable technical measures to prevent acquisition and modification - by unauthorized persons - of personal data transmitted electronically, while securing the set of data against unauthorized access; moreover, access to the account shall be granted upon entering a correct username and password.
